Effective March 5, 2026, the Homebuyers Privacy Protection Act introduced new rules designed to better protect consumers during the mortgage application process. These changes help give homebuyers more control over their personal information and reduce unwanted solicitations from outside lenders.

Under the new law, credit reporting agencies can no longer sell your information to other companies when you apply for home financing, with limited exceptions.

This means your credit information cannot be shared with other lenders unless:

  • You provide permission, or
  • You already have an existing account with the lender purchasing the information

This added protection helps ensure that your personal information stays within your control throughout the mortgage process.


Fewer Unsolicited Calls and Offers

Many borrowers have experienced an increase in unsolicited calls, emails, or messages after applying for a mortgage. These are often triggered when credit inquiry data is sold to other companies.

With the new privacy protections in place, homebuyers should see fewer unsolicited mortgage offers and communications from outside lenders when applying for financing.
